HUDSON PHOTOGRAPHY
TERMS & CONDITIONS
The following words or expressions shall have the meanings stated:
"The photographer(s)" means Jasmin Hudson and Abraham Skeete trading as Hudson Photography.
"Client (s)" means the person identified as the Client on a Booking or Order Form.
"Booking Form" means a form (whether or not printed on the reverse of these Terms and Conditions) completed by the Customer by which the Customer instructs the Photographer to create Material.
"Material" means all photographs, prints, transparencies, images, negatives, digital scans, digital files, design, artwork, montages, drawings, engravings and/or any other photographic product or other product comprising or containing reproduction of any form of photographic material, and which has been created by the Photographer.
"Price" means the price for an Order as set out by Hudson Photography
1. CUSTOMER SATISFACTION:
All client(s) are shown images on camera within the first 15 minutes of the session to ensure the photographer(s) are getting images to the clients expectations, at this point Client(s) are asked if they are happy with the images so far and are encouraged to say if they are not. The Photographer (‘s) ask the client at the end of every session if the client(s) are happy with the session and images. Hudson photography will reserve the right to deny unrealistic editing of images if the client has agreed to being happy with the images at the time of the session Including but not limited to settings and expressions.
1.1. IMAGES:
Quantity of images may vary depending on time spent on the photo shoot/ level of activity/ bad weather. Images will be a mixture of Black and white and colour images unless specified by client(s).
1.2. EXPRESSION:
Hudson photography will sometimes ask for parents to help encourage/ entertain children. Hudson photography would need full co operation from all parties involved to ensure the photographer(s) get the best images for you. In the event of Tears and tantrums and other such circumstances Hudson photography will not be responsible for the lack of expressive images.
1.3. INDEMNITY:
Hudson photography will always work to the best of their ability and will not leave a shoot unhappy with a wide selection of images that are of great quality. If Clients are unhappy with their images the client(s) are encouraged to let the photographer(s) know and the images will be reviewed. It is Hudson photography and the Photographer(s) Professional opinion on the result of the session. Hudson photography reserve the rights to deny a re-shoot or refund in the case where Hudson photography and the Photographer(s) are of the opinion they caught a wide selection of great quality images.
3. ILLNESS:
Hudson photography reserves the rights to postpone/ Reschedule a shoot in the event of staff illness/ illness of client(s). Hudson photography must be aware of any illness as we are working with children & families and would not want to pass any illness on. In The event of Hudson photography illness/ injury you are entitled to either a full refund of your deposit of your booking fee or to reschedule for another date at the availability of the photographer(s).
4. SAFTEY:
Hudson photography Promise to make sure all our equipments is safe for children to be around. In The event of a child being destructive, running into, pushing/pulling over equipments Hudson photography will not be responsible for any accidents/ injuries incurred.
5. DAMAGES:
Hudson photography is fully insured and will not leave expensive equipment in unsuitable place. In the case of damages to equipments caused by Client(s) / children, The Client(s) Are then liable to pay for any repairs or replacements.
6. DELIVERY:
Hudson photography Give a 2 week period for the delivery of your disk(s). Hudson photography will pay all postage and packaging for deliveries. Edits must be either chosen by client(s) or Photographer(s) within a 3 week period after disk being received and edits will be completed within One month of receiving final chosen images.
8. EDITING:
Hudson photography give the option to client(s) to make colour changes to images during the edit selection process, which include but is not limited to Black and white, colour and colour splash. Although is at the discretion of the photographer(s) to do what they feel works best for your images. Hudson photography reserves the right to deny any super imposing of images and unrealistic editing of images. Hudson photography Reserve the right to charge for any additional edits or for major editing works where Hudson photography was not at fault.
9. PAYMENT:
Payment must be made at time of booking or a booking fee must be paid.
Full payment must then be made from the time of booking or on the day we provide our service.
9.1 In the event of Non payments or refusal to make payment Hudson photography and the photographer(s) reserve the right to discard of all images from the session at the time of refusal.
9.2. Payment can be made through bank, cash, or paypal.
9.3. REFUNDS:
Hudson photography reserve the rights to make refunds on their professional opinion of the session and if Hudson photography can not attend a session due to unforeseen circumstances.
9.4 DEPOSIT:
Hudson photography requires 20% booking fee. This is the client(s) payment for securing a specific time/date and not part payment of our services. Upon completion of our service the 20% booking fee will be deducted from your final balance due. If the client(s) fail to make there date and time and fails to reschedule the booking then Hudson photography reserves the rights to keep the booking fee.
10. CANCELATIONS:
Hudson photography will need to be informed of cancellation 48 hours prior to the client(s) photo shoot. The client(s) will then have the following 7 days to book their shoot subject to the photographer(s) availability. If The Client(s) can not book a date within the 7 day remainder period Hudson photography reserve the rights to hold onto any booking fee paid and the client(s) will be required to pay a booking fee to secure another date. If Hudson photography can not make a date within the 7 day period due to Illness, Injury or prior commitments/ sessions Hudson photography will offer the closest 2 dates/times. In some cases this will not be convenient for the client(s) which Hudson photography will not be responsible for and for a different date the client(s) will be required to pay a separate booking fee.
11. STAFF RATIO:
Hudson photography will attend a home session with a minimum of 2 Staff(s)/Photographer(s).
11.1. Hudson photography can attend Locations shoots with 1 or more staff(s).
12. COOPERATION:
Hudson photography And all staff(s) at Hudson photography Reserve the rights to Terminate a session at any given time in the event of extreme rudeness, violence or un-cooperative behaviour from the Client(s).The client(s) will not receive any images from the session or a refund of payment/booking fee in these circumstances.
12.1 The Client(s) Are responsible for children at all times.
12.2 Hudson photography reserve the rights to pause a session if client(s) are taking photographs on a camera or using a camcorder. If the client continues to use a camera or camcorder the photographer reserves the right to terminate the session due to the client(s) persistent un cooperation. Hudson photography give permission for client(s) to take a few photographs on their camera phones/tablets as long as it is not affecting or distracting the photographer(s).
12.3 Hudson photography is not obliged to bring props/toys or any other form of entertainment for client(s) and encourage client(s) to provide the necessary.
13. VOUCHERS:
Any vouchers purchased from Hudson photography are non- refundable and can not be swapped to their cash value.
13.1 Any vouchers purchased from Hudson photography are not for resale/ reproduction.
13.2 Vouchers can be booked in advance depending on the photographer’s availability, and are subject to Hudson photography’s regular terms and conditions.
13.3 Hudson photography reserves the rights to edit the terms and conditions at any given moment.
13.4 Vouchers are valid for 1 year from the date they are issued.
14. ARTISTIC INPUT:
Hudson photography and the photographer(s) are entitled to use their judgement regarding style and artistic input in production of images. Including but not limited to poses, props and number of images taken.
15. IMAGE STORAGE:
Hudson photography store the images for a period of 3 months after the final edits have been sent back to the client(s), after which time the images will be deleted.
15.1 Hudson photography reserve the rights to deny replacement images if the client(s) occur any loss/ damage to their images once final edits have been made and clients have received all images in working/viewable condition.
15.2 If Loss/ Damage is Hudson photography’s wrong doing, Hudson photography will then be held responsible to see that a replacement is sent to the client(s) and the problem has been rectified.
15.3 Replacements can be purchased from Hudson photography within a 3 month period of the client(s) session.
16. COPYRIGHT AND TERMS OF USE:
all Material remains property of Hudson photography.
16.1 All Material is copyright to Hudson photography unless stated otherwise.
16.2 Hudson photography do print images upon purchase of prints or print packages through a proffesional printing vendor, Prints/products may change if vendor makes product/price changes . Hudson Photography do give rights to the client(s) to print images from the disk and distribute to family and friends and are not held responsile for quality of images printed outside of hudson photography or from external printing vendors.
16.3 Images may be displayed on websites As long as credentials are made to Hudson photography.
16.4 No Material is to be sold or used for commercial use without the written consent of Hudson photography.
16.5 Hudson photography reserves the rights to seek loyalties of any Material belonging to Hudson photography that are found to have been sold without consent.
17. STAFF RATIO:
Hudson photography will attend a home session with a minimum of 2 Staff(s)/Photographer(s).
17.1 Hudson photography Can attend Locations shoots with 1 or more staff(s).
18. INJURIES DURING A SESSION:
Hudson photography photo shoots may involve a level of physical activity and is undertaken at the client(s) own risk. Hudson photography and the photographer(s) will not be held responsible for any accident/ Injuries occurred during these activities.
18.1) Hudson photography may suggest poses/ activities for the client(s) and are not held responsible if activities are agreed to by clients and cause any injuries/accidents/loss/damage to person(s) or item(s),
19. DELAYS:
Hudson photography are mobile so in the unlikely event of any lateness / delays Hudson photography or the photographer(s) will keep client(s) informed during lateness/delays and give the client(s) the option to reschedule or a refund.
19.1) In the event of the Client(s) lateness/delays Hudson photography will wait until the client shows but can not guarantee that the full time booked will be given if Hudson photography or the photographer(s) have prior commitments. In these circumstances the client(s) are still required to make full payment.
19.2) if Full payment is refused Hudson photography reserves the rights to comply with terms and conditions stated in 9:1.
LAW & JURISDICTION
The contractual relationship between the photographer and the customer shall be governed by the laws of England and Wales.
These Terms and Conditions shall be governed by the laws of England and Wales.
Any dispute between the Parties relating to these Terms and Conditions shall fall within the jurisdiction of the courts of England and Wales.
